The new implementing regulation (EU) 2022/1157. What should be taken into account?

Since August 2022, the new Implementing Regulation (EU) 2022/1157 alone has been in force, replacing the previous Implementing Regulation (EU) 2021/1158.

What must the manufacturer do now?

Check whether the requirements (table columns 2 and 3) for an approved product have changed. If more than one table row exists for the same equipment, then there has been a change. The most recent requirements are always in the bottom line.

If changes have occurred, a transition period is indicated in columns 5 and 6, during which both the old and the new requirements can be applied. At the latest after the end of the transition period (date in column 6), the new requirements must be fulfilled.

The (EU) 2022/1157 must be included in the declarations of conformity.

What happens to old certificates (for example issued according to (EU) 2021/1158)?

Module B

If no changed requirements in (EU) 2022/1157 are specified for the equipment concerned, the existing certificate remains valid without restriction

If modified requirements in (EU) 2022/1157 are specified for the equipment concerned, these must be verified by supplementary tests by the end of the transition period at the latest. The notified body will then usually issue a new type certificate (Module B).

Modules D, E

If no changed requirements in (EU) 2022/1157 are specified for the equipment concerned, the existing certificate remains valid without restriction.

If changed requirements in (EU) 2022/1157 affect production, the production processes and the associated quality assurance procedures must be adapted accordingly. In this case, the responsible notified body must be informed. A new Module B certificate must be entered in the Module D or E certificate.
